If you represent a corporate entity, production house, or talent agency, you expressly warrant and represent that you possess the requisite legal authority and corporate power to bind such organization to these Terms.

Key Enforceable Safeguards:
  • Account creation signifies full assent to these Terms.
  • Users must possess full legal capacity under their governing jurisdiction.
  • Corporate representatives warrant binding authorization on behalf of their entity.
02MARKETPLACE STATUS

Nature of Service: Neutral Technology Intermediary

AUDITIONY provides workflow infrastructure, not employment or agency representation.

AUDITIONY operates exclusively as an online communications network, workflow tool, and technology infrastructure provider for the entertainment and performing arts industries. We connect independent professionals, including screenwriters, actors, casting directors, talent agencies, and production studios.

EXPLICIT DISCLAIMER OF AGENCY & EMPLOYMENT: AUDITIONY IS NOT A TALENT AGENCY, TALENT SCOUT, LABOR CONTRACTOR, CASTING AGENCY, OR EMPLOYER. We do not solicit employment, broker commissions, procure auditions on behalf of specific individuals, or act as an employer under any labor code or collective bargaining agreement (including SAG-AFTRA, equity unions, or regional cinema guilds).

All casting decisions, talent selections, audition invitations, salary negotiations, script acquisitions, and engagements are determined exclusively and independently by the respective users without platform intervention, endorsement, or liability.

Independent Relationship
No partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship is intended or created between AUDITIONY and any user.
03IDENTITY PROTOCOL

Professional Accounts, Vetting & Security Credentials

Human verification gates, accurate profile credentials, and credential security.

All users must provide accurate, current, and verifiable registration information. Impersonation of industry professionals, historical figures, or other creators is strictly prohibited and constitutes grounds for immediate termination.

INDUSTRY VETTING PROTOCOL: Accounts registered under Director, Casting Director, Producer, Talent Agency, or Studio designations are subject to mandatory manual review by our Trust & Integrity Board. We reserve the right to demand official company registration documents, commercial registries, tax identification, past filmography credits, and union/guild accreditation prior to granting access to casting call publication tools or talent contact directories.

You are solely responsible for safeguarding your login credentials, two-factor authentication tokens, and API access keys. You agree to notify AUDITIONY immediately at security@auditiony.com upon any suspected unauthorized access or compromise of your account.

Key Enforceable Safeguards:
  • Strict prohibition against pseudonymous industry decision-makers.
  • Human vetting gate for directors, casting teams, and agencies before publishing calls.
  • Strict account security and immediate reporting obligation for breaches.
04CORE SAFEGUARD

Anti-Exploitation Policy & Zero-Fee Guarantee

Absolute prohibition on audition fees, exploitative pay-to-play schemes, and coercive conduct.

AUDITIONY was founded on the fundamental principle that talent must be protected before it is served. We strictly enforce a zero-tolerance policy against financial extortion, abusive audition practices, and predatory behavior.

ABSOLUTE BAN ON SUBMISSION FEES: No Producer, Casting Director, or Agency may charge talents or actors any submission fee, audition toll, evaluation charge, or application fee of any kind for submitting to or attending a casting call. Mandating paid coaching classes, headshot packages, or agency representation as a prerequisite for casting consideration is strictly prohibited.

SAFETY IN AUDITION MATERIALS: Casting breakdowns and audition prompts must not require nudity, partial nudity, or sexually explicit actions in self-tape submissions or remote callback sessions unless accompanied by a verified union contract, an approved intimacy coordinator protocol, and advance written consent. Private physical measurements and sizing specifications submitted by talents are confidential and accessible solely for genuine wardrobe and production requirements under authorized projects.

Zero Tolerance Enforcement
Any user found soliciting fees or engaging in predatory behavior will face immediate permanent account termination, platform blacklisting, forfeiture of subscriptions, and referral to criminal authorities and industry guild blacklists.

Intellectual Property, Screenplay Vault & Watermarking

Author sovereignty, third-party media hosting, promotional talent spotlighting, and forensic watermarking.

TALENT & AUTHOR OWNERSHIP: Users retain 100% of their intellectual property rights, copyrights, trademarks, and moral rights in all original screenplays, pitch bibles, treatments, headshots, showreels, self-tapes, and audition submissions uploaded to AUDITIONY.

You acknowledge that certain video streams and media assets may be processed or hosted via authorized enterprise cloud services and third-party media infrastructure (including YouTube API Services and secure cloud storage) subject to their respective terms and data policies.

PUBLIC FEED SPOTLIGHT & PROMOTIONAL RIGHTS: For content, videos, and showreels that you voluntarily publish as 'Public' in the open platform feed or public profile portfolio, you grant AUDITIONY an additional non-exclusive, royalty-free license to feature, excerpt, or cross-post such public media across AUDITIONY's official social media channels (e.g., YouTube, Instagram, TikTok, LinkedIn) solely for the purpose of talent discovery and community spotlighting, subject to mandatory attribution to your creator profile. This promotional license expressly excludes unlisted materials, direct audition submissions, private self-tapes, confidential deal memos, and screenplays registered under Script Guardian™.

06CONTRACT GOVERNANCE

Independent Deal Memos, Contracts & Workspace Governance

Platform tools facilitate direct bilateral agreements; AUDITIONY is not an escrow or guarantor.

Users are strongly encouraged to engage independent legal and entertainment industry counsel prior to executing binding agreements.

Direct Contracting
Deal memos generated on the platform are direct bilateral agreements. AUDITIONY assumes no liability for breaches of contract, non-payment, or creative disputes between users.
